Terms of Use

These terms govern the use of the Sagacia app (hereinafter, «the app») and of its Premium subscription. By downloading, installing or using the app you accept these terms. If you do not agree with them, please do not use the app.

2. What Sagacia is

Sagacia is a brain-training app featuring a collection of short games about arithmetic, memory, attention and logic. The download is free and includes 3 complete games, with no time limit and with no payment required. The rest of the catalogue —17 games as of the date of these terms— is part of the Premium content. Three of those games also require completing 9 of the 11 achievements: that is a progression condition, earned by playing, and it cannot be bought separately.

The app works offline and stores your progress on the device; when you are online, that progress is synchronised with your account.

3. Account and player

• To save and synchronise your progress you need an account, created with your e-mail address.
• Each account corresponds to a single player, with their own name and avatar. An account cannot be shared between several people.
• To hold an account you must be at least 14 years old if you live in Spain, or have reached the minimum age set by your country for consenting to the processing of your personal data. Below that age, the account must be created and managed by whoever holds parental responsibility or guardianship.
• The account holder is responsible for the use made of the account, including use by minors in their care.
• You are responsible for keeping your access credentials confidential.
• You must provide accurate information. An account created with false data or impersonating another person may be suspended.

Groups. You can compete with other people by creating a group or joining one with a single-use invitation code. Creating a group or entering one requires active Premium content. Within a group, the other members can see your player name, your avatar, your season score and your challenge results; your e-mail address is never shared. Choose a player name that does not reveal anything you would rather not show and that does not infringe the rights of others: we may remove names or avatars that are offensive or that impersonate another person. You can leave the group whenever you want and you keep your progress; if your Premium expires while you are in a group, you will still see the group and be able to leave it, but challenges will be locked for you.

4. Licence of use

We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to install and use the app on your devices for personal, non-commercial purposes. The app is not sold: it is licensed.

You may not:

• Copy, distribute, resell, rent or transfer the app or the Premium access.
• Decompile, reverse-engineer or modify the app, except to the extent expressly permitted by law.
• Alter gameplay, scores or the unlocking system by means of external tools, or attempt to access Premium content without having purchased it.
• Use the app for unlawful purposes or in any way that harms the service or other users.

5. Premium content: plans and prices

Premium content gives access to every game in the catalogue —17 as of the date of these terms— and to any added while it remains active, and lets you create a group or join one. Three of those games also require completing 9 of the 11 achievements: that condition is about progression, not payment, and cannot be bought separately. It is obtained in either of two ways, both purchased through the app store (Google Play or the App Store):

• Annual plan: auto-renewing subscription, €6.99 per year.
• Lifetime: one-off payment of €14.99, with no renewals.

There may be launch or promotional offers. The one in force when these terms were published is the first year of the annual plan at €4.99, renewing afterwards at €6.99 per year, subject to the eligibility conditions and duration stated in the store itself. Once the promotion ends, the plan's standard price applies.

There is no free trial: the trial of the product is the three free games, which remain available at all times.

Prices are shown with applicable taxes included and in your local currency. The price in force at any given time is the one displayed by the app store before you confirm the purchase; the amounts quoted on this page are for reference.

6. Billing, renewal and cancellation

• Payment is processed by Google Play or the App Store, acting as merchants. NEOGAME DIGITAL SL neither receives nor stores your card details.
• The annual subscription renews automatically for equal periods, unless you cancel at least 24 hours before the end of the current period. The charge is made within the 24 hours prior to renewal.
• You may cancel at any time from the store itself. On Android: Google Play → profile picture → Payments and subscriptions → Subscriptions → Sagacia. After cancelling you keep Premium access until the end of the period already paid for.
• Uninstalling the app does not cancel the subscription.
• The «lifetime» unlock is a one-off payment linked to your account; it generates no further charges.

7. Right of withdrawal and refunds

As this is digital content made available to you immediately, by confirming the purchase you expressly request its immediate performance and acknowledge that you lose your right of withdrawal once it has been fully performed, in accordance with Article 103(m) of the Spanish consolidated text of the General Law for the Protection of Consumers and Users (and with Article 16(m) of EU Directive 2011/83/EU).

Refund requests are handled under the policies of the store where you made the purchase (Google Play or the App Store), which is the party that processes the payment. If you have a problem with a purchase, write to apps@neogamedigital.com and we will help you with the procedure.

8. Intellectual property

The app and its code, design, games, texts, graphics, sounds and trade marks belong to NEOGAME DIGITAL SL or to its licensors, and are protected by intellectual and industrial property law. These terms transfer no rights over them to you beyond the licence of use described above.

9. Availability and changes to the service

We work to keep the app available and running correctly, but we cannot guarantee an uninterrupted or error-free service. We may update the app, add games, modify existing ones or withdraw features for technical, legal or maintenance reasons. Should any change substantially reduce the Premium content you subscribed to, we will inform you and you will be able to cancel the subscription.

Games added in the future will, unless otherwise stated, form part of the Premium content.

10. Sagacia is not a medical device

Sagacia is a leisure and entertainment product. The results, scores and indicators it displays (including any «brain age» estimate) are indicative and intended for fun: they do not constitute a diagnosis, treatment or medical advice, nor do they replace assessment by a healthcare professional. No specific improvement in cognitive ability is guaranteed.

11. Data protection

The processing of your personal data is described in our privacy policy, which forms part of these terms. You can delete your account and your data by following the procedure on the support page.

12. Liability

NEOGAME DIGITAL SL is liable for damage arising directly from its own breach of these terms, in accordance with applicable law. We are not liable for loss of progress caused by using the app without a linked account, by the voluntary deletion of data or of the account, or by failures beyond our control (device, operating system, connection or app store).

Nothing in these terms limits the rights granted to consumers on a mandatory basis by consumer protection law.

13. Term and termination

These terms remain in force for as long as you use the app. You may stop using it and delete your account whenever you wish. We may suspend or terminate access, with prior notice except in urgent cases, in the event of a serious breach of these terms, fraudulent use or non-payment.

14. Changes to these terms

We may update these terms because of legal or technical changes or changes to the service itself. The version in force will always be the one published on this page, together with its update date. If a change materially affects you as a subscriber, we will inform you with reasonable notice and you will be able to cancel the subscription before it takes effect.

15. Governing law and complaints

These terms are governed by Spanish law. If you are acting as a consumer, you may bring proceedings before the courts of your place of residence and you retain all the rights granted to you by the consumer protection law of your country of residence in the European Union.
